Bu koşullar, Birthday Quiz Party uygulamasını ve misafir web sayfasını kullanan sizinle, uygulamayı geliştiren Furkan Aktürk (bireysel geliştirici, Türkiye) arasındadır. Uygulamayı kullanarak bu koşulları kabul etmiş olursunuz. İletişim: birthdayquizparty@protonmail.com

2. Hizmet nedir

Uygulama, bir doğum günü için soru–cevap quizi hazırlamanızı, quizi bir bağlantı üzerinden misafirlere göndermenizi ve sonuçları toplu olarak açmanızı sağlar. Misafirlerin hesap açması gerekmez; quizi tarayıcıdan çözerler.

3. Ücretsiz kullanım ve satın alma

Quiz hazırlamak ve önizlemek ücretsizdir. Quizi misafirlerle paylaşabilmek için o partiye ait bir bilet satın alınır.

  • Küçük Parti — 10 soru (en fazla 2'si görselli), 10 misafir.
  • Büyük Parti — 30 soru (en fazla 5'i görselli), 20 misafir.

Güncel fiyatlar uygulama içinde, App Store'un ülkenize göre belirlediği kademede gösterilir.

Satın alma abonelik değildir; tek seferliktir ve yalnızca satın alındığı partiye işler. Başka bir partiye aktarılamaz, geri yüklenemez ve devredilemez. İkinci bir parti paylaşmak isterseniz o parti için ayrıca bilet alınır. Satın alınan partinin sınırları sonradan değişse bile o parti alındığı sınırlarla çalışmaya devam eder.

4. Ödeme ve iade

Tüm ödemeler Apple tarafından tahsil edilir. Kart bilgilerinizi görmeyiz ve saklamayız. Faturanız Apple tarafından düzenlenir.

İade talepleri de Apple üzerinden yürür: reportaproblem.apple.com. İadeye Apple karar verir; biz doğrudan iade yapamayız. Apple bir satın almayı iade ederse, ilgili partinin ücretli özellikleri kapatılabilir.

Satın aldığınız bilet anında ifa edilen dijital bir içeriktir. Mesafeli Sözleşmeler Yönetmeliği m.15 uyarınca, onayınızla anında ifaya başlanan bu tür hizmetlerde cayma hakkı bulunmamaktadır. Tüketici mevzuatından doğan diğer haklarınız saklıdır.

5. Girdiğiniz içerik

Yazdığınız sorular, girdiğiniz isimler ve yüklediğiniz görseller size aittir. Onları yalnızca hizmeti çalıştırmak — yani quizinizi misafirlerinize göstermek — için kullanırız. Pazarlamada kullanmayız, başkasına vermeyiz.

Uygulamayı kullanırken:

  • Yükleme hakkına sahip olmadığınız görselleri yüklemeyin.
  • Başkalarının özel bilgilerini, onların rızası olmadan quiz sorusu yapmayın.
  • Hakaret, taciz, nefret söylemi veya yasa dışı içerik girmeyin.
  • Hizmeti aşırı yükleyecek veya güvenliğini kırmaya çalışacak şekilde kullanmayın.

Bu kurallara aykırı bir içerik bildirildiğinde ilgili partiyi uyarısız kaldırabiliriz. Girdiğiniz içerikten doğan hukuki sorumluluk size aittir.

🚩 Rahatsız edici bir quiz gördüyseniz bildirin. Quiz sayfasının altındaki "Bu quizi bildir" bağlantısı yeterli — hesap açmanız gerekmiyor. Uygulama içinden Ayarlar › İçerik bildir de aynı işi görüyor. Bildirimleri elden geçiriyor ve kurallara aykırı bulduğumuz partileri kaldırıyoruz.

6. Bağlantılar ve erişim

Misafir bağlantısı tahmin edilmesi zor rastgele bir kod içerir ama parola korumalı değildir. Bağlantıyı alenen paylaşırsanız quizi herkes çözebilir; bunun sonucundan siz sorumlusunuz.

7. Hizmetin sürekliliği ve sorumluluk

Hizmet "olduğu gibi" sunulur. Kesintisiz çalışacağını veya hatasız olacağını taahhüt edemeyiz; bakım, sağlayıcı arızası veya bağlantı sorunları erişimi geçici olarak durdurabilir.

Verilerinizin yedeğini almanız tavsiye edilir; teknik bir aksaklık nedeniyle veri kaybı yaşanması ihtimalini tamamen ortadan kaldıramayız.

Kusurumuzdan doğan zararlarda sorumluluğumuz, ilgili parti için ödediğiniz tutarla sınırlıdır. Kasıt ve ağır kusur hâlleri ile tüketici mevzuatının emredici hükümleri saklıdır.

8. Apple hakkında

Bu sözleşme sizinle bizim aramızdadır; Apple taraf değildir. Uygulamanın kendisinden ve içeriğinden yalnızca biz sorumluyuz. Apple'ın uygulama için bakım ve destek sağlama yükümlülüğü yoktur; destek talepleriniz için bize yazın.

Uygulama geçerli bir garantiyi karşılamazsa Apple'a bildirebilirsiniz; Apple satın alma bedelini iade edebilir. Bunun ötesinde Apple'ın uygulamaya ilişkin hiçbir yükümlülüğü yoktur. Ürün sorumluluğu, mevzuata uygunluk ve fikri mülkiyet iddiaları dâhil tüm talepler bize yöneltilir. Apple ve bağlı şirketleri bu koşulların üçüncü kişi lehtarıdır ve koşulları size karşı uygulama hakkına sahiptir.

9. Değişiklikler ve uygulanacak hukuk

Koşullar değişirse üstteki tarih güncellenir; önemli değişiklikler uygulama içinde duyurulur. Değişiklikten sonra uygulamayı kullanmaya devam etmek yeni koşulları kabul etmek anlamına gelir.

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Uyuşmazlıklarda İstanbul mahkemeleri ve icra daireleri yetkilidir; tüketicilerin, bulundukları yerdeki tüketici hakem heyetlerine ve tüketici mahkemelerine başvurma hakkı saklıdır.

1. Parties

These terms are between you, as a user of the Birthday Quiz Party app and its guest web page, and Furkan Aktürk (independent developer, Türkiye), who develops it. By using the app you accept these terms. Contact: birthdayquizparty@protonmail.com

2. What the service does

The app lets you build a birthday quiz, send it to guests as a link, and reveal the results together. Guests do not need an account; they take the quiz in a browser.

3. Free use and purchases

Building and previewing a quiz is free. To share a quiz with guests you buy a ticket for that party.

  • Small Party — 10 questions (up to 2 with images), 10 guests.
  • Large Party — 30 questions (up to 5 with images), 20 guests.

Current prices are shown in the app, in the App Store price tier for your country.

A purchase is not a subscription. It is one-off and applies only to the party it was bought for. It cannot be transferred, restored to another party, or reassigned. To share a second party, a separate ticket is purchased for it. If the tier limits change later, an already purchased party keeps the limits it was bought with.

4. Payment and refunds

All payments are collected by Apple. We never see or store your card details. Apple issues your receipt.

Refund requests also go through Apple: reportaproblem.apple.com. Apple decides on refunds; we cannot issue one directly. If Apple refunds a purchase, the paid features of that party may be turned off.

The ticket is digital content supplied immediately. Under Turkish distance sales rules (Distance Contracts Regulation Art. 15), there is no right of withdrawal for such services once performance has begun with your consent. Your other statutory consumer rights are reserved.

5. Your content

The questions you write, the names you enter, and the images you upload are yours. We use them only to operate the service — that is, to show your quiz to your guests. We do not use them for marketing and do not give them to anyone else.

When using the app:

  • Do not upload images you do not have the right to upload.
  • Do not turn other people's private information into quiz questions without their consent.
  • Do not enter insulting, harassing, hateful, or unlawful content.
  • Do not attempt to overload the service or break its security.

If content violating these rules is reported, we may remove the party without notice. You are legally responsible for the content you enter.

🚩 If you see a quiz that troubles you, report it. Use the "Report this quiz" link at the bottom of the quiz page — no account needed. Inside the app, Settings › Report content does the same. We review reports and remove parties that break these rules.

6. Links and access

The guest link contains a hard-to-guess random code but is not password protected. If you publish the link openly, anyone can take the quiz, and you are responsible for that outcome.

7. Availability and liability

The service is provided "as is". We cannot guarantee uninterrupted or error-free operation; maintenance, provider outages, or connectivity problems may temporarily interrupt access.

You are advised to keep your own copy of anything important; we cannot entirely rule out data loss caused by a technical fault.

For damages caused by our fault, our liability is limited to the amount you paid for the party concerned. Cases of intent and gross negligence, and mandatory consumer law provisions, are reserved.

8. About Apple

This agreement is between you and us; Apple is not a party to it. We alone are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app; send support requests to us.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other obligation with respect to the app. All claims — including product liability, regulatory compliance, and intellectual property claims — are directed to us. Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.

9. Changes and governing law

If these terms change, the date at the top is updated and significant changes are announced in the app. Continuing to use the app after a change means accepting the new terms.

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction; consumers retain the right to apply to the consumer arbitration committees and consumer courts at their own location.
